You battle to get healthy when you’re sick, diligently arming yourself with medication, surgeries and doctors’ visits in the war against disease. But, for many, there’s another unexpected fight — a battle against health insurance companies who may refuse to pay for crucial treatment or may even drop you entirely.

When it comes to health insurance, what you don’t know can hurt you, so the best time to make sure you’re really covered is before you become ill. Taking some simple measures now can help prevent problems later.

To find out what you need to know about your health insurance but probably don’t, MSNBC.com turned to two experts.

Rhonda Orin is the managing partner of the Washington, D.C., law office of Anderson, Kill & Olick, P.C. and represents policyholders in disputes with health insurance companies. She is also the author of “Making Them Pay.”

William Shernoff is the senior partner of Shernoff Bidart Darras, a Claremont, Calif.-based law firm that represents insurance policyholders. He’s the author of three books, including “Payment Refused.”

Don’t fall victim to ‘secret program’
A surprising number of patients have been in the middle of costly treatment for a serious disease only to have their policies canceled, sometimes even retroactively, and found themselves responsible for astronomical bills. It’s called rescission.

“It’s a secret program that if you have a serious illness … or are on costly medications, when they get the bills, they go through [your file] and look at your application … and get medical records from the last several years. And if they find an inconsistency in your application, even if it’s an honest mistake, your policy is rescinded,” says Shernoff. “It’s a very harsh punishment visited upon a lot of people.”

Shernoff represented plaintiffs in a class action suit against Blue Cross in California that resulted in the company being fined $1 million in March 2007 for rescinding 6,000 policies without proving that patients willfully falsified their applications.

Answer the questions as best you can. And if you’re not sure if you’ve had a certain condition or treatment, write down that you don’t remember, he says. Most forms don’t allow space for that answer, so be prepared to have to squeeze it in.

How to keep from getting denied
Some insurance companies will veto a doctor’s orders if they feel the treatment isn’t necessary or consider it experimental, says Shernoff. “They do a lot of denial for newer treatments, especially cancer treatments.”

Try to get treatment preapproved if you have any question about whether it’ll be covered. But that can also send a warning sign to the insurance provider.

“Preapproval is often what triggers the rescission review,” says Shernoff. “If it’s for hip surgery, that’s an expensive item that they’ll look at and see if you’re a candidate for rescission.

“I think that's why people are so frustrated in that there's not a lot you can do to avoid getting caught up in these denial programs,” Shernoff adds.

What you can do, he recommends in his book “Payment Refused,” is make sure you read your policy carefully and follow exactly the steps your insurance company requires for filing a claim.

Orin emphasizes playing by the insurance company’s rules. Make sure you know what is covered, she advises in her book, so when you call for preapproval you can say with authority that you’ve checked and have met the criteria for a particular procedure.

How to appeal a decision
If you’ve been denied coverage for a claim, you can appeal to the insurance company, your state’s department of insurance or you can file a lawsuit, says Shernoff.

If you appeal to the company, know that it usually goes to the medical director, who is an employee of the insurance group, he notes.

Have your doctor write a letter explaining why it was a necessary procedure. If possible, include journal articles showing the effectiveness of the treatment. The key is to get the doctor to make a stronger case than the insurance company has and make it hard for them to say it’s not medically necessary.

Insurance companies don’t like lawsuits, he says, but most patients don’t like to get involved in litigation.

“You’re trying to get well and going through chemo and it’s not the time for you to be fighting your company. Bills don’t get paid and you get turned over to collections and your credit is getting ruined,” he says. “It’s tragic and outrageous … ”

What your state says insurance must cover
Many people don’t know that each state has a mandate of treatments that forces health plans to cover certain treatments, regardless of what the insurance company policy is, says Orin.

Some mandates, reprinted in Orin’s book “Making Them Pay,” ordered coverage for some surprising things, including infertility expenses (Illinois, Montana, New York and other states), toupees and wigs for cancer patients (Massachusetts), surgery for morbid obesity (Indiana), cochlear implants (Kentucky) and baseline testing for lead poisoning in children (Delaware).

Orin’s book collects mandates from the year 2000 for all 50 states, but to get current information, she suggests visiting the Web site of your state department of insurance.

Not everyone is eligible under the mandates, but if you purchase your policy independently, you definitely are, says Orin. If you purchase it through your work, you might be.

Find safety in numbers
Very few policies are rescinded if people are in a group. “There’s more bargaining power,” Shernoff explains.

People are also less likely to have a claim denied if they’re part of a group. If that happens, unhappy policyholders employed at corporations can complain to human resources. And if the employer feels the employees aren’t being well taken care of, it may decide to choose a different insurance company instead.

Individuals who can’t get coverage through an employer should look for a group to join, such as the AARP or an association affiliated with your job. (Occupations ranging from fitness trainers to trial lawyers have associations that offer group insurance.)

Do everything in writing
Orin advises conducting exchanges in writing via fax, snail mail or e-mail if you can find an address. Try not to do anything over the phone. “It’s frustrating, it takes forever and when you hang up, it didn’t happen,” she says.

If you do have to have a conversation by phone, get the customer service representative’s name and phone number and listen for the sound of them typing to make a record of your call.

Try not to get too emotional
If a claim has been turned down or you feel an error has been made, treat it like you’re the bookkeeper for a company and that you have to make sure the bill is paid, suggests Orin.

Read the insurance forms to make sure you know what is getting covered and what isn’t.

“To catch that mistake, you have to have some sense of what’s going on in the first place,” she says. “Don’t assume everyone else is right and you are wrong.”

Scrutinize the fine print
Some health insurance companies advertise to attract small mom-and-pop business, Shernoff says. While at first it may look like the policy covers major medical costs, the fine print may reveal that’s not necessarily true.

“You have to be really careful to find out what the benefits really are,” he says.

That includes learning what the insurance company is willing to pay for procedures. Some policies say they cover 80 percent of “reasonable customary charges.” But if a doctor submits a bill for $20,000 worth of treatment, the company could claim that’s not a reasonable charge.

Lastly, keep your records
Make sure you hang on to the records of your correspondence and other documents, Orin advises.

Even once your claim has been paid, it’s a good idea to keep to the paperwork for three or four years, she says.

S&P Upgrades New York Life Insurance

NEW YORK -

Standard & Poor's Ratings Services on Thursday raised its credit and financial strength ratings for New York Life Insurance Co. and New York Life Insurance & Annuity Corp.

The credit rating agency said the upgrade reflects the companies' top position in the market for life insurance, high earnings and measured risk management.

S&P raised its counterparty credit and financial strength ratings for both companies to 'AAA' from 'AA+.' Companies rated 'AAA' have the highest levels of reliability and stability. The outlook for the insurance companies is 'stable,' according to S&P.

New York Life Insurance has especially benefitted from a highly productive sales force, which boosted life insurance sales 5 percent in 2006 despite a tough market, according to S&P.

Additionally, S&P notes the company has been successful in international markets such as Mexico and India.

Going forward the credit rating agency expects continued strong earnings from the companies on growth in its U.S. insurance business.

Pittsburgh, PA (AHN) - A Pennsylvania Superior Court judge has been indicted on charges of fraudulently collecting $440,000 from insurers by claiming he suffered debilitating injuries in a car crash while leading an active life.

According to federal prosecutors, Judge Michael Thomas Joyce golfed, skated, and went scuba diving after claiming the insurance money for his injuries which he claimed left him in constant pain and unable to exercise. The judge also went for inline skating and received his pilot's license.

Associated Press quotes U.S. Attorney Mary Beth Buchanan as saying on Wednesday, "The bodily injury he says he sustained we believe was fraudulent."

Despite being indicted in the case, the 58-year-old judge not only claims to be innocent until proven guilty but also promised to carry on with his campaign for a second 10-year term. He is up for re-election in November.

Joyce, charged with mail fraud and money laundering, is due in court for an initial appearance Monday. According to the indictment, he received $390,000 from his insurer, Erie Insurance Group, and $50,000 from State Farm Insurance, which insured the other driver.

The three mail-fraud counts are the most serious Joyce faces, each carrying a maximum 20-year prison sentence. Prosecutors also allege that though Joyce's car was met with an accident at about 5 mph in August 2001, no police or medical personnel were called.

Following the accident, he complained of debilitating injuries, anxiety and difficulty sleeping and claimed they prevented him from pursuing higher judicial office.





Drivers Pay W594,000 Car Insurance Premium on Average

Drivers paid 594,000 won ($626) on average as car insurance premiums rose last year, 4.9 percent up from the previous year. The increase, however, doesn't seem to be offsetting non-life insurers' snowballing losses.

According to the General Insurance Association of Korea (GIAK), car insurance premiums paid in the fiscal year 2006 ending in March this year totaled 9.5 trillion won. Given that the number of registered cars totaled 16.06 million, an average 594,000 won auto insurance premium was levied upon each car. It is 28,000 won more than that the previous year.

Faced with mounting operating losses, insurance companies have taken measures to raise insurance premiums, differentiating premium rates according to car models, and overhauling premium surcharge or discount systems.

Despite the insurance premium increase, insurers are not gaining in profitability. They paid 439,000 won for each car on average, up 3.8 percent from the previous year. The number of payments to subscribers also surged 7.1 percent from a year ago to 7.06 million.

Non-life insurers recorded 833.9 billion won in operating losses, up 62.4 percent from the previous year. Their loss ratio, or the ratio of incurred losses and loss adjustment expenses to earned premiums, averaged 78.3 percent, up 0.7 percentage points from a year ago. Operation expenses, including salaries and marketing expenses, surged 17.1 percent to 6.3 trillion won.

While non-life insurers are suffering from low premiums that are not sophisticatedly differentiated, premiums for life insurance companies are expected to become far more differentiated from October.

According to a number of life insurance companies, most life insurers here plan to reflect the risk ratio based on their own experience when setting insurance premiums. Currently, insurers set premiums based on the data of the Korea Insurance Development Institute.

``The risk ratio is likely to go up as the population in each insurer's statistics is much smaller than that from the Korea Insurance Development Institute. It may lead to an insurance premiums hike,'' a spokesperson of a life insurance company explained.

China's Ping An Insurance H1 profit jumps 139.5 per cent

Ping An Insurance (Group) Co, China's second-largest life insurer, posted about a 139.5 per cent gain in first-half profit, driven by contributions from its Shenzhen Commercial Bank unit and strong investment returns.

Ping An, which trails market leader China Life Insurance Co, reported net profit of 9.969 billion yuan ($NZ1.93 billion) in the six months ending June 30, compared with 4.162 billion yuan in the year-earlier period.

On average, three analysts polled by Reuters expected the Shenzhen-based company to earn 9.43 billion yuan.

Last month, Ping An said it expected its first-half net profit to more than double based on domestic accounting standards, boosted by increased returns from its fledgling banking and investment businesses.

Being properly insured in case of accidents overseas is essential given that more than a third of drivers in the survey by Norwich Union admit they have accidentally driven on the wrong side of the road and 42 per cent have admitted looking the wrong way when approaching junctions.

Erik Nelson of Norwich Union said: "It is important to understand that fully comprehensive motor insurance in the UK does not automatically mean the same level of cover abroad, and so we urge people to contact their insurer to assess their level of cover when away, and decide whether to upgrade their policy prior to their trip."


Many drivers with comprehensive car insurance will find their policies bumped down to third-party cover as soon as they drive outside the UK.

Hoping for the best could prove an expensive mistake, as the cost of car accidents abroad can vary from an average of £1,445 in France to £5,180 in Sweden and Denmark, according to Norwich Union.

Major insurers such as Admiral, Barclays, HSBC, More Than, RAC Direct Insurance and Zurich do not automatically extend comprehensive cover abroad on standard policies, according to statisticians Defaqto.

Some insurers will provide enough comprehensive cover on the Continent for you to nip away for a weekend.

For example, Direct Line, Egg, esure, Halifax, MBNA Europe, NatWest, Royal Bank of Scotland and swiftcover.com policies all include foreign trips for three days at no extra charge. AA Insurance, American Express, Churchill and Marks & Spencer include comprehensive cover for trips of up to 90 days abroad.

While Norwich Union policies include cover for foreign trips of up to 90 days as standard, with Norwich Union Direct you will have to pay extra for the privilege.

Insurers generous enough to include foreign use with unlimited days of travel in your normal premiums include Cornhill Direct, NFU Mutual and Saga.

As our motor insurance table indicates, if you contact your insurer before departure, you can usually pay extra for extended comprehensive cover on the Continent.


For example, a family holidaying in their Ford Mondeo would need to pay esure an extra £29 to extend comprehensive cover for a fortnight in France on top of annual premiums of £209 including a discount for buying over the internet.

Whether you are an annual holidaymaker or a frequent channel hopper, a cheaper deal does not usually mean the best deal.

Graeme Trudgill, technical services manager for British Insurance Brokers' Association said "Cheaper comprehensive motor insurance tends not to extend to European use. You might have to pay a daily rate, if you want to extend your cover beyond third-party and sometimes you end up spending a lot more.

"It is important to find just how much the day rate is, especially when buying over the internet."

Perdue’s insurance fix shouldn’t become another entitlement

Gov. Sonny Perdue last week proposed the most significant expansion of the state’s role in funding health care since the creation of PeachCare a decade ago.

He would spend up to $50 million in state and federal funding to subsidize a third of the premiums for employees of small businesses — those with 50 or fewer employees — with incomes below 300 percent of the federal poverty level. That’s $30,600 a year for a single adult and about $62,000 for a family of four. The employer and employee would each pay a third, as well.

The numbers will take a while to settle. The governor thinks that 380,000 uninsured Georgians work for small businesses and that his plan would enable 30,000 of them to buy insurance.

Ken Stewart, the commissoner of the Department of Economic Development, testified before a House-Senate committee Thursday that 600,000 businesses exist in Georgia and that 95 percent of them have fewer than 50 employees. The Georgia Department of Labor put the under-50 number at 252,172, with 1.5 million employees. It reports, too, that 36.9 percent of firms with fewer than 50 employees already offer employee coverage.

The numbers now are not so important as the policy. Offering a taxpayer subsidy to private individuals and companies requires compelling public purpose. And once over that hurdle, it requires, too, a carefully drafted law that specifically targets and tightly contains this genie.

It’s contained initially the way PeachCare was when Congress created the State Childrens Health Insurance Program. That is, it was specifically declared not to be an entitlement, with spending capped. The PeachCare target population was the working poor with incomes below 200 percent of the federal poverty level who couldn’t afford health insurance.

Three significant changes have occurred since. One is that pressure immediately built to expand eligibility. In Georgia, that was done with the first onrush of excess tax collections. The second is that this Congress is turning PeachCare into an entitlement, and raising the eligibility level to about $83,000 for a family of four, meaning that taxpayers will foot the bill for what is becoming a middle-class welfare program, no matter the cost. The third change is that parents are dropping private insurance in favor of the cheaper and better taxpayer-funded program. Half or more of the children signed up were switched from private insurance.

Perdue intends to cap Georgia’s contribution at $20 million, which would come from savings achieved through better management of the Medicaid program. Once created, however, the pressure is immediate, persistent and intense to expand, just as was the case with PeachCare.

To be considered, too, are the behaviors we buy. At present, almost 40 percent of small business owners have sacrificed and made the responsible choice to provide medical insurance to their workers. The inevitable result of a program that offers a 33 percent subsidy is that all eligible employees will be shifted into the public program — those with and those without insurance.

It’s possible, too, that individuals will create sole proprietorships and at-home businesses for the sole purpose of qualifying.

Provisions will be made to check abuse with audits and eligibility reviews — necessary, but a workload that will require additional employees.

Clearly there is a problem that needs attention if in fact employers are not providing health insurance and employees are not buying because they can’t afford it. “I don’t know if just waiting and not doing anything is going to help,” said Dr. Rhonda Medows, commissioner of the Department of Community Health. “We are going to end up paying more in uncompensated care.”

The verdict? Depends. Can it be contained? Is it the beginning, as a key House member, State Rep. Earl Ehrhart (R-Power Springs), asserts of a new entitlement? And what behaviors — desirable and not — are we buying

Hartford is getting a brand-new company to support its nickname as the Insurance City: SPARTA Insurance Co., a business insurer with a twist.

It's relatively rare for a new insurer to be created in Connecticut as an independent company, not as part of an existing insurer. So SPARTA's upcoming launch is welcome news in the city, which still has such household names as Aetna, Travelers and The Hartford but is trying to bolster its reputation as an insurance capital.

SPARTA, which completed private funding arrangements Thursday, will sell to groups of customers that have something in common, such as business associations and franchises, instead of selling to individual businesses.

The company will sell traditional commercial auto, general liability, workers' compensation and property insurance to such groups. But it will also sell alternatives to regular insurance that involve customers assuming at least some of the risk of claims, as the SPARTA name suggests: Specialty Program and Risk Transfer Alternatives.

The alternatives could include, for instance, SPARTA sharing a set percentage of the risk of claims with customers, or covering only the highest levels of claims.

In addition, SPARTA will also arrange a "captive" upon request - an insurance company that would serve only a particular customer group.
